This is due to health and safety reasons for Baby Products. To the fullest extent permissible pursuant to applicable law, Mommy Xpress disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. Mommy Xpress does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Mommy Xpress does not make any warranties or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some states do not permit limitations or exclusions on warranties, so the above limitations may not apply to you.

Insurance New Patient Information

Patient attests that they are either pregnant or breastfeeding and all information provided to Mommy Xpress is true, complete, and accurate. Initial breast pump orders and supplies are provided based on an average monthly supply needed to begin breastfeeding a newborn. Average information is determined by evidence-based practice and international guidelines on milk expression which is every 3 hours in a 24-hour period. Patient agrees to reorder supplies as necessary for their breastfeeding needs.

Insurance Patient Reorder and Monthly Subscription Information

Patient attests that the information provided to Mommy Xpress is true, complete, and accurate. Patient is still actively breastfeeding and in need of on-going supplies. The items selected on the patient’s insurance order form are based on what is necessary for the patient to continue their breastfeeding needs. A patient who submits a Monthly Subscription form agrees to inform Mommy Xpress 7 days prior to the following month’s shipment of any changes to what is necessary as needed.

Limitation of Liability

Mommy Xpress shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products, even if Mommy Xpress has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Typographical Errors

In the event that a Mommy Xpress product is mistakenly listed at an incorrect price, Mommy Xpress reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Mommy Xpress reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Mommy Xpress shall issue a credit to your credit card account in the amount of the incorrect price.

Term; Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Mommy Xpress without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification, Dispute Resolution, and Miscellaneous, shall survive any termination.

Changes to These Terms

We may revise these Terms and Conditions at any time by posting an updated version on this page. Changes take effect when posted, and the “Last updated” date at the top of this page will reflect the most recent revision. Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Mommy Xpress may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Mommy Xpress.

Miscellaneous

Your use of this site shall be governed in all respects by the laws of the state of Ohio, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Mommy Xpress products) shall be in the state or federal courts located in Cincinnati, Ohio. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Mommy Xpress products) must be commenced within one (1) year after the claim or cause of action arises. Mommy Xpress’s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Mommy Xpress may assign its rights and duties under this Agreement to any party at any time without notice to you.

Dispute Resolution; Arbitration

Please read this section carefully, as it affects your legal rights. Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or your use of the site (including but not limited to the purchase of Mommy Xpress products) that cannot first be resolved informally shall be resolved by binding individual arbitration rather than in court, except that you or Mommy Xpress may bring an individual claim in small claims court if it qualifies. The arbitration shall be administered by a recognized arbitration provider under its applicable rules and conducted in or near Cincinnati, Ohio, consistent with the governing law described above. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and Mommy Xpress agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims or otherwise preside over any form of representative or class proceeding.

Some jurisdictions do not permit certain limitations on dispute resolution or class actions, so portions of this section may not apply to you. If any portion of this section is found to be unenforceable, the remaining portions will continue to apply to the fullest extent permitted by law.

Privacy

Your use of this site is also governed by our Privacy Policy, which explains how we collect, use, and share your information. Because we provide products and services that involve health information, our handling of medical and health information is described in our Notice of Privacy Practices. Please review both documents.

Use of Site

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Mommy Xpress or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

Participation Disclaimer

Mommy Xpress does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Mommy Xpress is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However Mommy Xpress reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or other intellectual property right of another or (d) offensive or otherwise unacceptable to Mommy Xpress in its sole discretion.

Indemnification

You agree to indemnify, defend, and hold harmless Mommy Xpress, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Third-Party Links

In an attempt to provide increased value to our visitors, Mommy Xpress may link to sites operated by third parties. However, even if the third party is affiliated with Mommy Xpress, Mommy Xpress has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Mommy Xpress. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Mommy Xpress seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

Text Messaging Terms

These Text Messaging Terms (the “SMS Terms”) govern your use of the SMS text messaging program (the “Program”) operated by Pediatric Products, LLC, doing business as Mommy Xpress (“Mommy Xpress,” “we,” “us,” “our”). By opting in to the Program, you agree to these SMS Terms in addition to the rest of these Terms and Conditions.

1. SMS Messaging Service. Mommy Xpress provides an SMS messaging service to patients who have opted in. Messages may include appointment reminders, prescription and insurance verification updates, order and shipping notifications, breast pump accessory resupply eligibility notices, surveys, and general assistance.
2. How You Opt In. You opt in by providing your mobile phone number on the Mommy Xpress qualification form at mommyxpress.com and checking the SMS consent box, which presents the disclosure quoted in our Privacy Policy. You may also opt in by providing express verbal or written consent through another Mommy Xpress channel. After opt-in, you will receive a confirmation SMS.
3. Message Frequency. Message frequency varies. You can expect approximately 2–4 messages per month, with up to 1–5 messages per week during active order, qualification, or resupply periods.
4. Message and Data Rates. Standard message and data rates may apply based on your mobile carrier’s plan. Mommy Xpress is not responsible for any charges from your carrier.
5. Privacy Policy. Your personal information is handled in accordance with our Privacy Policy.
6. Opt-Out Instructions. You may opt out at any time by replying STOP or UNSUBSCRIBE to any SMS message. After opting out, you will receive a final confirmation message and will no longer receive SMS messages. To opt back in, reply START or YES. For help, reply HELP or contact us at 844-641-2255.
7. Eligibility. You must be at least 18 years old, or the parent/legal guardian of the patient, to opt in. By opting in, you confirm that you are the subscriber of the mobile phone number provided, or have the account holder’s permission to enroll that number.
8. Liability. Mommy Xpress is not responsible for any charges, delivery delays, errors, or failures caused by your mobile carrier, third-party service providers, or factors outside our reasonable control. SMS delivery is not guaranteed.
9. Consent Is Not a Condition of Purchase. Your consent to receive SMS messages is not a condition of purchasing any product or receiving any service from Mommy Xpress. You may decline SMS messaging and still receive equipment, supplies, and care.
10. Data Sharing. Your mobile information will not be sold or shared with any third parties for promotional or marketing purposes. We may share your mobile information with service providers (such as our SMS platform vendor) only to the extent necessary to deliver the messages you have opted in to receive, and as otherwise described in our Privacy Policy.
